BELLEFONTE, Pa. (WHTM) -

Court Notes from Day Two of the Jerry Sandusky child sexual abuse trial:

8:59 a.m. – Judge John Cleland and jury enter.

9:01 a.m. – The prosecution calls Victim 1. He is 18 years old. In 2004 and 2005 he lived with his mom and brother and sister in a public housing apartment. In 2004 he was about 10 years old. He never knew or met his biological dad. Victim 1 was introduce to the Second Mile through a suggestion by the school. He went to a Second Mile camp and said it was fun. He stayed overnight at camp for six days. He said there was swimming and other activities but doesn't remember much about the first year he went to camp.

9:04 a.m. – Like Victim 4, Victim 1 met Sandusky personally the second year he went to the Second Mile Camp. He said Sandusky spoke to him personally about the camp, he asked him if he was having fun, what could make it better, etc… The first time he saw Sandusky outside of camp was shortly after his second or third year going to camp and Sandusky came down to Victim 1's school with two or three other kids and wanted to take him out and do activities. Did you want to go?: "At the time, yes. It seemed real fun to do."

9:06 a.m. – The first place they went was Blanchard Dam. They went swimming and Sandusky would throw them in the air and into the water. Victim 1 said about a month later (he doesn't remember specifics and the prosecutor notes he was only 10 years old), they did another activity. He said many times he and Sandusky did activities alone and with other kids but mostly with other kids. After a while, the time he and Sandusky spent together was more one-on-one. Victim 1 participated in wrestling and said Sandusky would come to his matches and take pictures. Victim 1 said Sandusky suggested that they start spending time together and he asked Victim 1's mom about it. Victim 1 said his mom "kind of let me do my own thing" but said "Hey, it might be good if you go do some stuff with Jerry." Victim 1 said the things he did with Sandusky was fun and with his mom encouraging him he went along with it.

9:09 a.m. – The first time Victim 1 stayed over Sandusky's house they ate lunch and dinner and played games in the basement, pool, shuffle board, air hockey, darts, etc… There were two other children there the first time Victim 1 stayed over but he does not remember if those children stayed the night as well. Victim 1 said Sandusky would put his hand on his leg while Sandusky was driving but Victim 1 said, "I didn't really think anything of it" and didn't tell anyone about it. The first time he stayed over Sandusky's house it was a Saturday. The prosecutor asked Victim 1 where he stayed at Sandusky's house. He said a couple of times he stayed in guest bedrooms upstairs and after that on the right side of the basement.

9:12 a.m. – At first, Victim 1 said he would stay over Sandusky's house on occasion. In the summer, he would stay over almost every week. Victim 1 said he stayed at Sandusky's house over 100 times. He said Sandusky would pick him up at his house and he would sleep in the basement room, which is right off the stairs to the right with a water bed and TV.

9:13 a.m. – Victim 1 pauses before answering the question. At first it was, Sandusky kissing him on the forehead at night…then it was the cheek, then it was him rubbing my back, then it was him pulling me on top of him and cracking my back. This happened more than once. Victim 1 said he thought that this meant Sandusky saw him as family and "this was just what his family does." Victim 1 said he thought about mentioning it but thought this was just what Sandusky's family does. Victim 1 said Dottie Sandusky was always upstairs.

9:15 a.m. – The prosecutor asked Victim 1 what he meant by cracking his back. Victim 1 paused and explained that Sandusky would pull him on top of him so they were lying face to face. Sandusky would rub his back and then pull him close so his back would crack. Victim 1 said this happened every time he stayed in the basement, which was most times. Victim 1 said he did not say anything about what was happening. He said he "I didn't think it was anything wrong…" I didn't think it was anything. When these instances happened, they were both usually wearing shorts and a T-shirt.

9:17 a.m. – Sandusky would lay on Victim 1's left side and not really say much. He would roll on top of Victim 1 and just lay there and after a while he would roll over again so Victim 1 was on top of him. Prosecutor tells Victim 1 he has to ask him some difficult question and asks if he's ok. Victim 1: "I'm ok." His breathing is heavy. After kissing my forehead and cheek, he moved to my lips "he kissed my lips and then he started rubbing my back again…then he began to rub underneath my shorts in the back." Victim 1 pauses. "That went on for a while and then, as he was laying on top of me…kissed me on the forehead and cheeks…he rolled back over so he was on top of me, lifted up my shirt and blew on my stomach….like you do to a little baby to get them to laugh…I didn't know what to think. I had a bunch of thoughts running through my mind but nothing that were back…the fight or flight response did not kick in."

9:19 a.m. – Victim 1 said he was about 11 or 12 years old when this happened. He said he was well under 100 pounds. The prosecutor asked Victim 1 if he was scared, he said he was puzzled and his mind was running in different directions. Victim 1 said he never told his mom, "It never occurred to me." Victim 1 said he never told his mom, "I don't want to go back over there."

9:20 a.m. – During the school year, Victim 1 would stay every week or every other week. In the summer, he would stay for days or weeks until Sandusky brought him home. Victim 1 said his mom felt nothing was wrong with it. Victim 1 said when Sandusky touched his butt he didn't know what to think and was extremely confused. You can hear Victim 1 breathing heavily into the microphone. He answers after a pause. "After cracking my back and rubbing his hands down the back of my shorts and the blowing on the stomach he…[pause and heavy breathing, sniffling] he…[sniffling]…he put…[heavy breathing] he put his mouth on my privates [pause]…I spaced I didn't know what to do, with all the thoughts running through my head, I just kind of blacked out and didn't want it to happen." Did you say anything to him?: "I couldn't, I was froze." Did he say anything to you: No, "It just happened…I don't even know." Victim 1 begins crying and breathing heavily. Did you tell your mom: No. Did you tell anybody: No. Did you tell him to stop: "No. I didn't know what to say. I was embarrassed, I was confused. I didn't know what to do."

9:24 a.m. – Victim 1 said his mom felt like he was doing things with Sandusky that she couldn't do with him. "She kind of enjoyed the fact that I had a role model…I couldn't just say no." Victim 1 is sobbing. Did that happen again?: Yes, in the basement bedroom. "It was the same kind of routine, cracking my back, rubbing my back, putting his hands down the back of my shorts, it was always after he blew on my stomach that it would happen….It was after the back cracking and rubbing and blowing my stomach. It was probably after a couple months or so after I started staying at his house that he started doing that." Would he do it every time you went to his house?: About 80 to 90 percent of the time. "As soon as he blew on my stomach that is when it would happen."

9:26 a.m. – Victim 1 is choking back tears and sniffling, breathing heavily. He said other than that it was "pretty much like any normal time, he would take me back to do stuff," we'd eat, I'd take a shower and the routine would start again, "back cracking, rolling around in bed…he would put his hand down the back of my shorts, except this time he sat there and said something along the lines of "it's your turn" and he made me…[pause and sobbing, blows his nose] he made me put my mouth on his privates." This occurred in the basement. The bailiff brings Victim 1 a tissue and he continues crying. This happened when he was close to 13 years old. "I don't know how to explain it. I froze like any other time…my mind was telling me to move, I couldn't I couldn't do it, I couldn't move." Then, he looked at me and walked away.

9:29 a.m. -- Victim 1 said he didn't tell his mom because he was embarrassed and was afraid she might not believe him. "There was a million thoughts running around my mind; I couldn't tell anybody." Victim 1 said he never knew when Sandusky would try to make him give oral sex to Sandusky…but he always knew when Sandusky would give him oral sex because Sandusky would blow on his stomach first. Victim 1 said Sandusky's wife Dottie was always upstairs.

9:31 a.m. -- Victim 1 said he stayed at hotels with Sandusky sometimes but can't remember the names. Victim 1 said he would argue with his mom and siblings sometimes but nothing more than normal. Victim 1 said at the beginning of camp "it was good, but then when I started staying with him it [my behavior] change noticeably…I started acting out, I started wetting the bed….I got in to fights with people." Victim 1 said he was still wrestling and playing a little football. But he then stopped playing football. "It's not that I didn't enjoy it, cuz I did. It was just the fact that, I…I just didn't want to see him anymore. He would come around, talk to me about football, take me to football camps…I started to just fall away from it."

9:33 a.m. – In middle school Sandusky would come to football work outs. In high school, Sandusky was a volunteer football coach for their team. He would come to school and ask the assistant principal, who was also the football coach, if he could talk to Victim 1. So, they would call Victim 1 over the intercom. Victim 1 said he didn't want to go to the office because it meant you were a troubled kid. He said because he was always getting called to the office, his history teacher thought he was getting into trouble. His grades suffered and he started getting C's. He used to get A's and B's??

9:35 a.m. – "I was actually just trying to get my work done and not have my co-teacher for history hate me and fail me….there was one time that I tried not going and then the next time I went down he kept me for even longer…and the buses left me so he asked the principal if he could take me home and the principal said yes." Victim 1 said Sandusky took him to Victim 1's home. Victim 1 said Joe Miller saw he and Sandusky rolling around in the middle school weight room. Victim 1 and Sandusky were lifting weight and then he decided to go mess around on the rock wall. He said Sandusky lifted him off the wall and placed him on the blue matt and was rolling around with him, cracking his back, etc… Then Joe Miller walked in. The prosecutor asks, "Were you scared when that happened?" Victim 1 answered "Yes, but I kind of felt a relief that nothing was going to happen."

9:39 a.m. – "I decided I was going to start avoiding him…It started off, when I would stay at his house, I would hide, underneath the pool table, in the closet space, trying to draw out time until he would go upstairs or his wife would call him upstairs." He said after Sandusky found him once, there was really no place to hide. He was in 9th grade when he had a disagreement with Sandusky. Victim 1 takes a deep breath. "I joined this local thing called the Big Brother, Big Sister, they pretty much did the same thing as the Second Mile but it was locally…I started spending less and less time with Mr. Sandusky and he would call and try to make arrangements. He actually came to my home and argued with me. It started out just a normal conversation but then he started yelling at me about making time for him and spending more time with him." Victim 1 said his mom called his grandfather when this happened and his grandfather came over.

9:41 a.m. – Victim 1 said when he got called out of history class one day he decided to skip history class and the meeting with Sandusky. He also skipped his last period and just went straight to the bus. When he got on the bus he noticed a car that looked like Sandusky's. Victim 1 got out of the bus at a friend's bus stop but his friend wasn't there so Victim 1 started walking home. Sandusky pulled up and hollered at him. He asked Victim 1 why he wasn't spending time with him, why he wasn't answering his calls, etc… Victim 1 said it was because he had other things to do, the Big Brother, Big Sister program. Victim 1 said he got "extremely scared" so he started walking away. Sandusky yelled at him to get in the car but Victim 1 shook his head and kept walking away. Sandusky then put the car in reverse and Victim 1 started running. He ran down and alleyway and then went home. When he got on to his street he saw Sandusky standing at his house arguing with his mom. He hid down the street and eventually his mom waved to him and told him to go in the back door. Victim 1 said Sandusky got the gist for a while but then kept calling, calling and calling.

9:44 a.m. – "I didn't tell my mom or anybody right out….I actually asked my mom what the website was for people who do things to children." His mom asked if it was Megan's Law and why he wanted to see the site. Victim 1 told his mom he wanted to see if Jerry was on there to try to give her the gist, "But I don't think he got it." His mom later set up an appointment for Victim 1 to see the guidance counselor. After a couple of hours of talking, the counselor asked if Sandusky did anything to him and Victim 1 broke crying down and said yes. The counselor called his mom and they said they needed to go to the police or Children and Youth Services. The school officials told him they needed to decide what to do, Victim 1 said: "They said he has a heart of gold and he [Sandusky] wouldn't do something like that."

They went to Children and Youth and met with a girl named Jessica. He said he "didn't tell her very much of anything" but Jessica thought he told her everything. He said she asked about his bed wetting and he said no but his mom said yes. He said he didn't say everything because Jessica was a girl. Next, he talked to a man named Matt and there was a police state trooper in the room. He said he didn't tell them everything because of "embarrassment…I wanted to forget it ever happened…I couldn't tell them everything."

9:48 a.m. -- Victim 1 said he met with the guidance counselor because he thought it would keep Sandusky away from him. Victim 1 said when he talked with Jessica he was scared because of all the connections Sandusky had. "I was afraid he could hurt me or someone close to me." Victim 1 also talked with a Children and Youth physiologist and a Grand Jury. Victim 1 said when he talked to the Grand Jury he broke down, he couldn't move: "I couldn't tell them…I didn't really have a choice." When talking, Victim 1 said he completely broke down and his mom was holding him. "It was just horrible."

9:50 a.m. – Victim 1 said he told the Grand Jury the majority of everything when he was before them the first time. The second time he went before the Grand Jury it was a new set of people and he broke down crying after answering a question. "I just wanted it to be put behind me and be gone. I didn't even want to think about," Victim 1 said.

9:52 a.m. – Victim 1 said he graduated from high school on Thursday. Victim 1 begins examining photographs of evidence.

Photographs: A bag of golf clubs Sandusky gave Victim 1 as a gift. A shirt, shoes, dress pants and a dress shirt. A photograph of the pool and hot tub a hotel where he and Sandusky stayed.

9:58 a.m. – Amendola introduces himself to Victim 1 and begins cross-examination.

9:59 a.m. – Victim 1 said he was 10 or 11 years old when he got involved with the Second Mile. Victim 1 said he got involved because the Second Mile sent information out to schools and the school recommends students to the camps. He said to his knowledge he got referred to the camp because he didn't have a father figure and his family didn't have the means to do things. Victim 1 said his sister and his whole family went through his mom's ex-husband being very abuse. His sister developed bi-polar disorder because of this. Victim 1 said his mom had previously called Children and Youth because his sister was acting out and actually punched a cop in the face. The first year he went to the Second Mile camp Victim 1 said it was on Penn State's campus. Victim 1 said he stayed in the dorms sometimes and camping in tents later on. Victim 1 said he had roommates and people who hung out with him. He doesn't remember their names and said they weren't "close, close friends."

10:01 a.m. -- Victim 1 saw Sandusky during the first camp and did not meet him formally. Victim 1 said the only contact he had between then and the next year were letters promoting the camp the next year. The second year he went to camp he stayed in the dorms with a roommate. Victim 1 does not recall the names of his roommates. Victim 1 said he met Sandusky that year in a more formal way. Sandusky asked him about the camp, asked if he was having fun. "I assumed he asked that to everybody." The camp was six days long. Victim 1 said he recalls being thrown by Sandusky in to the pool, he remembers talking to Sandusky but that was it until after camp. He said he started having one-on-one contact with Sandusky after the end of third year of camp. He said before this he mostly spent time in groups. When he started having one-on-one contact with Sandusky he was 11 or 12. During the summer Victim 1 stayed at Sandusky's for three to six days.

10:06 a.m. -- Victim 1 said the first physical contact occurred when he was maybe 11 or 12. He said it started with Sandusky's hand on his leg in the car and progressed to when he was staying downstairs. He said it never happened when he stayed upstairs, which was rarely. Victim 1 said sexual encounters (i.e. oral sex) would not happen at hotels. Victim 1 said they stayed overnight at hotels 1 to 3 times. There was a queen bed in the room and told Sandusky there was a cot that could be used but Victim 1 never saw the cot and they stayed in the same bed. Victim 1 said oral sex only occurred at Sandusky's home. Victim 1 said the oral sex occurred at night and Dottie was home. Victim 1 said there was one night when Dottie called down to Sandusky when Sandusky was rubbing and cracking his back. Sandusky left and Victim 1 said this was the only time he got a decent amount of sleep. Victim 1 said he spent more time with Sandusky than he did with most of his family at the time. Victim 1 said about 80-90 percent of the time he stayed over Sandusky's house oral sex would occur. "And then he had me do it to him…His wife was upstairs, I believe, she could have went out somewhere…but to my knowledge she was upstairs…She never came downstairs…even when we were playing games and stuff…I never once saw her down in that basement."

10:11 a.m. – Amendola asked Victim 1 if he enjoyed golf; Victim 1 said he didn't really understand the rules. Amendola asks Victim 1 is he knew the golf clubs Sandusky gave him were donated to the Second Mile. Victim 1 said Sandusky told him to use the golf clubs but they didn't go golfing frequently. Victim 1 said he used the dress pants, shoes, etc…so he could take Victim 1 to church with Sandusky and his wife. "That was the first time I actually went to church…" Amendola said that Sandusky was trying to introduce Victim 1 to church.

10:14 a.m. – Victim 1 said when Joe Miller walked in on he and Sandusky wrestling at the school it was still light out but he can't remember the exact time. This was in the auxiliary gym weight room. They were weight lifting and Victim 1 was climbing on the rock wall. When Miller walked in on them rolling around on the maps, Sandusky "hopped up like a rabbit…[and said] Oh I'm just showing him some wrestling rooms…Joe Miller obviously didn't think anything of it till now." Victim 1 said he fell off the rock wall and laughed about it. Amendola asked Victim 1 if they went back to the weight room to climb the rock wall not to be in a secluded area. Victim 1 said the only activity that occurred back there was Sandusky being on top of him, him being on top of Sandusky and Sandusky rubbing his back. But "nobody asked him to get on top of me and roll around…," Victim 1 said.

10:19 a.m. – Amendola asked Victim 1 if he told the school administration that someone approached him in the bathroom, said they were from the Second Mile and asked him who he said he was. Victim 1 said during the school year that he watched the school entrances like a hawk; he was afraid someone would come in and give him an anxiety attack. "I saw a man, he confronted me, it startled me." Amendola asked: Are you aware that school officials conducted an investigation and found no evidence of a man that you described?

10:21 a.m. – Amendola asks Victim 1 if he ever said anything to his mom or anyone that you're "Going to get rich off this deal." Amendola asked Victim 1 if he has a lawyer. He said his mom hired an attorney to keep the press away from him. Victim 1 said his mom's boss (who is a private investigator) told her to get an attorney to help her with the press and "put [Victim 1]'s mind at ease."

10:23 a.m. – Victim 1 said: "All I know is that I'm here to tell the truth about what happened to me…just like anyone else." "I have dreamed about living in a big house, I have dreamed about driving nice cars…doesn't everybody?"Amendola asked him if he ever verbalized it. He said no.

10:24 a.m. – Victim 1 said the first time he went to Children and Youth he said nothing sexual happened. He said he didn't talk about it because the person interviewing him was a woman, he didn't want to talk about it and had just told the counselor. Victim 1 said he told them nothing sexual happened "I even denied wetting the bed because I was embarrassed." Amendola said Victim 1 mentioned skin-on-skin contact to troopers. Amendola asked Victim 1 if the first time he mentioned oral sex was to Trooper Rossman (sp?). Victim 1 said, "I told my psychologist that something more happened when I first met with him…I just didn't feel comfortable telling him right then and there…it was either him or Trooper Rossman that I told first."

10:27 a.m. – Amendola asked if Trooper Rossman or the physiologist was the first one to mention oral sex. Victim 1 said his mom's boss told her it would be a good idea to get an attorney for the press. Contact completely stopped in Victim 1's 9th grade year. Amendola: do you remember telling the trooper the oral sex started in the summer of 2007 and continued until the summer of 2008? Amendola: do you remember telling Children and Youth that the oral sex started in November of 2007 and continued until the summer of 2008? Victim 1 said he does not remember the exact dates that he told each person. Victim 1 said he did deny the oral sex at one point, before the Grand Jury, but later broke down on the stand before the Grand Jury. "I had to tell them the truth. I didn't want to, but I didn't really have a choice." "I don't even want to be here," he said.

10:32 a.m. – Amendola: Was the grand jury trying to get you to say that oral sex occurred?: "No, they were trying to put me at ease." Amendola: asked Victim 1 if he told Children and Youth Services that ten assaults occurred in hotels and asks how that could happened if they were only in hotels five times. The attorneys go to side bar and the judge recess.

10:56 a.m. – Court is back in session. Victim 1: "I was a little kid, I don't know how many hotels we were in but I know of we were in a few…And with everything that I was trying to forget…I just don't know how many hotels I was actually in." Amendola: when you said three or four that was a rough estimate? Victim 1: yes. "I don't remember what I testified to, I just remember that it happened."

10:59 a.m. – Amendola asks Victim 1 specifics of what he testified to. "I know that as I talked to people, and I felt comfortable enough telling them, which was tough for me…I may have white lied to cover embarrassment…but I am here now telling the full truth." Victim 1 said he does not remember who he told what to. He said he told different things to different people at the level he felt comfortable. Victim 1 said he gave rough estimates of the number of times oral sex occurred to set his mind at ease. Amendola said he told some it was 10 or more times, some it was 20 or more times. Victim 1 said he told the first grand jury the least amount of times that oral sex happened. He said the second time he was before the Grand Jury he was told he had to tell them everything. Amendola asks Victim 1 if he told the Grand Jury Sandusky did not touch his penis with his hand, Victim 1 said he was scared and there were new people. Victim 1 Sandusky did do this. Amendola asks Victim 1 if he said this one time and denied it another. Victim 1 said he was just trying to forget what happened and was scared. Amendola: Would you agree there are two very different statements? Victim 1: "Yes, but I will stress to you again that I was scared when I was testifying…there was a lot of stress in me not wanting to say what happened that I…I, I broke down. I couldn't. I will say that they were two separate statements but I was scared for one and the other one I knew what I had to do." Victim 1 said that he was scared when he said Sandusky did not touch his penis. Victim 1 said he knew if he was going to grow up and leave it all behind him that he had to tell the truth; he said it was stressed to him that he must tell the truth.

11:08 a.m. – "I was scared, you can't expect a young many to come out with this to new people every single day," Victim 1 said. Victim 1 said when he testified to the Grand Jury there were reporters throughout the building; he said there was one very persistent reporter and "I just didn't want that," he said. Amendola said Victim 1 told police he performed oral sex on Sandusky more than once. Amendola said he told the Grand Jury it happened only once. Victim 1 said he used that solid number to set his own mind at ease.

11:11 a.m. – Victim 1 said he was interviewed by state police and Children and Youth Services (Jessica, Matt, a state trooper and a psychologist). Amendola asks Victim 1 if he had interviews about 20 times. Victim 1 said he see the psychologists every Thursday. Victim 1 said it was still hard to talk about it every time. Victim 1 said it takes a while for him to come out with this story to new people. Amendola asks Victim 1 why he kept telling different people different stories. Victim 1: "I'm sorry, you keep asking me the same questions over and over again and I am going to give you the same answers…There were new people."

11:15 a.m. – Victim 1 asks Amendola to stop asking him the same questions. Amendola asks him if he needs a break. The judge tells Victim 1 this is not an argument. Amendola: You are telling us what you are saying today is the truth? Victim 1: Yes.

11:17 a.m. – Victim 1 said he went to the park with Sandusky and his sister at least once. Amendola asked Victim 1 if he remembers Sandusky coming to his house to pick him up to volunteer at a Second Mile event. He said yes. Amendola asks Victim 1 if Sandusky ever told him not to tell anyone what was happening; he asked if Sandusky ever threatened to hurt him. Victim 1 said no.

11:19 a.m. – Prosecutor: Did anyone ask you to say something just because you said it before? Victim 1: No. Victim 1 said he first told his counselor in 2008 or 2009. Victim 1 said he was a teenager and thought about having nice cars but said when he went to Children and Youth Services he just wanted Sandusky to stop.

11:22 a.m. – Victim 1 steps off the stand after being on the stand for nearly two and a half hours.

11:23 a.m. – Victim 1's grandfather takes the stand. Victim 1's grandfather said Victim 1 lived with his mother, brother and sister in public housing. Victim 1's grandfather said ever since Victim 1 was little he took Victim 1 with him everywhere. Victim 1's grandfather said he knows Sandusky and saw him pick up Victim 1 sometimes and that Sandusky would sometimes come to Victim 1's wrestling tournaments. Victim 1's grandfather said he only had small talk conversations with Sandusky about Victim 1.

11:25 a.m. -- Victim 1's grandfather said Victim 1's mother would come over to the house one time because Sandusky had been there for about an hour and wouldn't leave. When he got to the house, Victim 1's mother and Sandusky were out front. He thinks Victim 1 was in the house. Victim 1's grandfather said Sandusky wanted Victim 1's summer schedule so he could take Victim 1 with him. Victim 1 kept telling Sandusky that he didn't know exactly what his plans were. Victim 1's grandfather said he eventually told his daughter to go in the house and he told Sandusky to just take one of the other kids he was mentoring. Victim 1's grandfather said Sandusky told him he just needed to know Victim 1's grandfather.

11:28 a.m. – Amendola asks Victim 1's grandfather if he ever called Sandusky and encouraged him to take Victim 1 places. Victim 1's grandfather said he was the one who would take Victim 1 to his wrestling tournaments. Victim 1's grandfather said when he went to Victim 1's home to meet Sandusky he did not know there were allegations against Sandusky.

11:29 a.m. – The testimony of Victim 1's grandfather ends after six minutes. The prosecutor calls for the next witness and the bailiff brings in the wrong witness.

11:32 a.m. – The witness is sworn in. Ms. Musser has been an employee at the Hilton Garden Inn for ten years. She does not know Sandusky but he has been pointed out to him once.

Photographs: The fitness center and pool area. Ms. Musser said she was instructed to issue Sandusky a key to their pool and fitness center to bring Second Mile children to swim. She had her staff do so.

11:35 a.m. – Amendola begins cross examination. Musser said she had not heard complaints of Sandusky being inappropriate with children in the pool. She said there is a security camera in the pool area but it is not very clear. She said the tapes were not reviewed unless an issue was reported. She said when they were using VHS tapes they would tape over the same tapes every weeks. Now they use a digital system. Musser said she never knew of a request to review a tape involving Sandusky.

11:37 a.m. – Cynthia Burns is sworn in. She works at the Hilton Garden Inn in State College. She has been the director of housekeeping for 10 years. She did now know Sandusky in 2004 or 2005.

12:01 p.m. – Documents: receipts for hotel rooms; one hotel room had two beds another had one king sized bed and pull-out couch.

1:00 p.m. - Judge enters. Court is in session.

1:03 p.m. - Amendola introduces himself to Dershem and begins cross examination. He asks her to recall that he was with Sandusky back in 2009. It was November 20, 2008 that Victim 1 first came to CYS. Dershem said her coworker who took the call from Victim 1's principal filled out the initial document. In the initial document it says the principal told CYS there were allegations of inappropriate contact with Sandusky including sleeping in the same bed, contact over clothes, etc…but no mention of oral sex.

1:06 p.m. - That document says: "(Victim 1) states that he and Mr. Sandusky's clothes were always on." The document shows that Victim 1 said these instances occurred 30 times altogether and about 10 occurred out of town. The document said: "When asked where he would sleep when he would be out of town with Mr. Sandusky, Victim 1 shared that sometimes there would be one bed and sometimes there would be two beds in the hotel room." Workers asked Victim 1 if there were any other actions by Sandusky that made him feel uncomfortable. Victim 1 said there was nothing else. This question was asked several times and Victim 1 gave the same response. During one interview, the social worker stated that she would like to video tape the interview; she was granted permission to do so after the trooper was done with his part. The trooper said he did not like videotaping interviews because they "helped out the defense lawyers."

1:12 p.m. - Victim 1 indicated that back cracking would occur between 5 and 20 minutes. After the interview, the social worker was told by the trooper that he felt there was enough information to press charges. Dershem said Sandusky was not required to come to the CYS office for an interview but he chose to. Sandusky made a statement that day and Amendola asks Dershem to read the statement. The prosecution objects

Sandusky said Victim 1 helped him with two football camps. Sandusky said they didn't always stay at hotels when they were out of town; once they stayed at his son's house, Sandusky said. Sandusky denied ever sleeping in the same bed as Victim 1; he said there were always two beds or a pull-out couch. Sandusky said it was after he pulled Victim 1 out of the school assembly that things got tense. Sandusky said he never took Victim 1 out of any classes at school. Sandusky said he gave Victim 1 a homemade birthday card with a picture of Victim 1 on the front. The picture was from a newspaper and pictured Victim 1 in a track meet. Sandusky did not deny Victim 1's accounts of back cracking. Sandusky said Victim 1 only stayed at his house eight times. Sandusky said he wanted to make Victim 1 feel important because Victim 1 never talked about his own father. Sandusky said it was not unusual for him to kiss other children on the forehead or hugging them. Sandusky said when he drove in the direction of Victim 1's bus he asked Victim 1 to get in the car. Sandusky said he later went to Victim 1's house to explain to his mother what was going on.

1:26 p.m. - Dershem said in the beginning of this interview that Sandusky did not know the exact allegations against him.

1:29 p.m. - There was at least one other interview with a state trooper that CYS was not aware of. Dershem said this is not uncommon. Dershem said ¾ of the statements made by Sandusky were self-serving and meant to defend himself. Dershem said that her interview with Sandusky indicated an inappropriate relationship between Sandusky and a young boy. Dershem said the relationship between Sandusky sound like a relationship between two immature adolescents trying to break up. Dershem said egregious sexual activity with a minor is usually private. Dershem said the interview with Sandusky did not change her opinion of the presence of sex abuse. There are three levels of sex abuse: unfounded, indicated or founded.

1:35 p.m. - Dershem steps off the stand. Mike McQueary is called to the stand and sworn in.

1:37 p.m. - McQueary said he was a student from 1993-1997 as a student and he returned as a graduate student in 2000. He was a graduate assistant football coach and Penn State paid for his schooling. He was an on-field football coach. McQueary was a football player when he was at Penn State.

1:38 p.m. - McQueary said he knew all the coaches, including Sandusky. McQueary was a quarterback when he played for Penn State. As a graduate assistant McQueary helped out with the tight ends. McQueary moved to State College when he was seven years old. McQueary said as a graduate assistant coach you are involved with recruiting, watching tapes, etc…but you do as you are told. Coach Paterno was his overall boss; Ganer was his more immediate supervisor. He had known them for about eight years.

1:40 p.m. - In February McQueary said he was watching a movie, Rudy, but later decided to go to the office to look at some recruiting tapes. He went to the Lasch Football building. Earlier that day he had bought a pair of sneakers and decided to put those in his locker. His locker was in the support staff locker room. When he opened the door he heard shower running "I heard smacking sounds, very much skin-on-skin smacking sounds…I became very much alerted and embarrassed that I was walking in on something." McQueary's locker was just inside the door, as he was opening the locker he looked into the mirror and in the reflection "I see Coach Sandusky standing behind a boy, who is propped up against the shower…he is right up against him, his back with his front, the boys hands are up on the wall. The glance would have only taken one or two seconds. I immediately turned back to my locker…trying to digest what I just saw….I stepped a few paces to the right to get a glance with my own eyes…I looked directly in to the shower." McQueary said he saw Coach Sandusky standing right up against the back of a young boy with the boy's hands up against the shower wall. Sandusky's arms were wrapped around the boy's midsection. McQueary said he was "extremely alarmed, extremely flustered, extremely shocked, all those things." McQueary said: "I went back to my locker, which was 2-3 paces away from where I was just standing. I tried to think…I put the shoes in the locker, shut the locker door as hard as I could…at that time, both individuals were separated and looking right at me." They were was 3-5 feet apart. "We looked directly in each others's eyes." At that point, I left the locker room.

1:45 p.m. - McQueary said the boy was prepubescent and between 10 and 12 years old. He was only about chest-high. McQueary said he heard skin-on-skin slapping sounds. McQueary said the only place the sounds could have come from was from Sandusky and the little boy. McQueary said he did not see much movement from Sandusky. McQueary said he did not hear slapping sounds when he saw Sandusky and the little boy. McQueary said there were not fast movements but very slow movement from Sandusky's midsection. McQueary said he could not process it right away. "This is the Penn State football building…no, you don't register that." I made that noise to say" "Someone's here…break it up. Please. I wasn't thinking 100 percent right. I'm used to high pressure settings" and that was more than I could handle. I slammed the door, looked in to the shower and saw Sandusky and the boy standing four to five feet apart. McQueary immediately went upstairs to his office. He immediately picked up the phone and called his father to "get advice from the person in my life I trusted the most…because I had just seen something ridiculous."

1:50 p.m. - McQueary said he told his father the "surface" of what he had seen. McQueary's father told him to leave the building and go to their house. McQueary's parents lived 5-7 minutes away from the Lasch Building. McQueary talked to his father, by himself. McQueary's father said he wanted to digest for a minute what McQueary had just told him; McQueary's father called a friend and confidant. They came over. McQueary was at his father's house for about an hour.

1:52 p.m. - McQueary said he did not get overly into detail with his dad and dad's friend. He said he made sure they knew it was "sexual, wrong and perverse." He said, "Dad you don't have to be a rocket scientist to know what was going on." His father and friend told him to tell Coach Joe Paterno. He called Paterno at 7:15 a.m. on a Saturday morning. McQueary asked Paterno if he could come over. He told McQueary: "No, I'm not giving you a job." McQueary said it was important. McQueary said he went over and told Paterno. McQueary said he made it known that it was sexual.

1:57 p.m. - McQueary said he received a phone call from Tim Curly about a week after McQueary talked to Paterno. Curly told him he wanted to talk to him about what he had seen. He met Curley in a conference room on Penn State's Campus. Gary Schultz was also present. The conversation lasted about 15 minutes. McQueary said he talked to Curly one or two weeks after this conversation. He said they looked in to what McQueary had said. McQueary said Schultz represented the police to him and McQueary did not report the incident to anyone else. McQueary said he saw Sandusky after that but nothing was ever said between them. McQueary said over the years the only people who knew were family members, who probably came to know about it after several years. He said he may have trusted the information to his girlfriend. He said he thought Schultz was like a district attorney for the university.

"If Jerry came in the equipment room I would get up and leave real fast…I think people became suspicious of my actions…I would say 'I just don't care to be around him.'"

2:03 p.m. - McQueary then spoke to police when they approached him.

2:06 p.m. - Photographs presented. The photo shows the staff support locker room. His locker is the closest to the door. When you are in the shower, you can see McQueary's locker reflected in the mirror.

2:08 p.m. - The attorneys talk at the sidebar with the judge.

2:24 p.m. - Questioning resumes.

2:25 p.m. - Photograph: two manikins of a tall man, on the right facing toward the camera and on the left, a couple of feet away, a shorter figure also facing the camera. Another photograph is show with McQueary's reflection in the mirror, which is what you would have seen from the shower. Another photos is shown with McQueary standing by the mirrors, which is where he said he would have been standing when he took a couple of steps to look in to the shower with his own eyes.

2:27 p.m. - Assistance Defense Attorney Karl Rominger begins cross-examination. Rominger tells McQueary that a statement from State Trooper Rossman says he only saw Sandusky and the boy from two positions. McQueary maintains that he saw them three times (in the mirror, when he turned around to see them with his own eyes and after he slammed his locker door). McQueary said he remembers the night not because he was taking shoes to the locker but because of what he saw, saying he saw something "horrific." Rominger brings up the fact that McQueary once said the incident took place in 2002 but now maintains it took place in 2001. You don't call the police?: "No I did not." McQueary said it would have been a minute's drive to Campus Security. McQueary said it took about 10 to 12 minutes from the time he talked to his father to the time he saw him. McQueary said he felt his father was aware the situation was sexual in nature when they got off the phone. "He definitely knew something disturbing was going on and I saw it…He knew it was extremely sexual in nature, he knew a young boy was involved, he knew Jerry was involved."

2:39 p.m. - McQueary said his first glance into the shower (via the mirror) was narrow and lasted 2 or 3 seconds. McQueary appeared before the Grand Jury in December 2010. McQueary said he cannot be sure if he saw Sandusky in the shower before or after he got to his locker. McQueary said he has never met with any FBI agents, that he knows of. "Jerry Sandusky right behind the boy in an extremely sexual position; his front right up against his back." McQueary said he saw the same thing the first two times he saw Sandusky and the boy. On the third look, McQueary said, "I don't know how they (S,, ,, , Sa, ndusky and the boy) didn't see me." McQueary said He believes he made eye contact with Sandusky and the boy but he cannot be certain that Sandusky reciprocated the glance.

2:47 p.m. - Rominger states some names. Rominger said that McQueary wrote in an email "I didn't just turn and run, I made sure it stopped." McQueary said he did make sure it stopped by slamming his locker door. When he left, McQueary said "The sexual action that I witness had stopped. They were separated."

2:49 p.m. - "I made sure Coach Joe knew it was sexual." McQueary said

2:52 p.m. -- "I have never showered with any young boy who was not the son of a coach," McQueary said. McQueary said the support staff locker's room was different from the coach's locker room. During football season, on Sunday, Monday and Tuesday coaches would work from about 6:30 a.m. to 10-11 p.m. at night. Later in the week it trails off and you leave at 8 or 8:30 p.m. Rominger asked if it would have been reasonable for Sandusky to have time to play racquetball and basketball. McQueary said he and Sandusky were not employed full time together for very long. He said Paterno was a guy who trusted you to get your work done and wouldn't keep tabs on you.

3:15 p.m. - Court resumes. Rominger said McQueary wrote in an email that he talked to the police and the head of the police. Rominger asks who the police were. McQueary says he thought Schultz was the police.

3:19 p.m. - Rominger asks McQueary if he recalls talking with Sandusky about a potential walk-on student. McQueary said no and that he does not recall having any conversations with Sandusky after witnessing the incident in the shower. McQueary said he made a strong effort not to be associated with Sandusky. Rominger states that he believes McQueary has bias in this case because he thinks he is filing a lawsuit. McQueary filed some form of whistleblower lawsuit against Penn State. "Frankly, I want to be a football coach at Penn State University and I don't have that opportunity right now…I don't think I've done anything wrong to lose that job."

3:24 p.m. - Originally McQueary thought the incident happened the Friday night before Spring break in 2002. Later, McQueary said it was in February 2001. Rominger asks McQueary if it was him or prosecutors and police who settled on the March 1 date. McQueary said: "I recall a lot of things in my life that are very clear and vivid but I don't recall the dates to them, sir." McQueary said that to determine the date they looked at Comcast cable schedules and Penn State employment records (because Joe Paterno told McQueary he was not giving him a job at Penn State when he called to ask Paterno to talk about what he had seen in the locker room).

3:28 p.m. - Rominger read a portion of the Grand Jury transcript in which McQueary said the young boy saw him on the second view. McQueary said today he is giving as much detail as he possibly can. "I know the boy knew I was in the locker room….they were separated," McQueary said.

3:34 p.m. - McQueary said no words were spoken. McQueary said he cannot be 1000 percent sure that intercourse was occurring. "I saw them three separate times. They were naked…"

3:38 p.m. - Rominger is now questioning the witness on the age of the boy. McQueary said he was prepubescent. McQueary said it doesn't matter his exact age. "The fact is he had sex with a minor boy," he said. McQueary said he thought he was maybe 10-years-old.

3:40 p.m. - Rominger read from a Grand Jury statement, in which McQueary said: "I was nervous and flustered so I just didn't do anything to stop it." Rominger said McQueary wrote in an email that he did do something to stop it. McQueary defends his testimony saying "I physically did not remove the boy from the shower…I did not go punch Jerry out" but McQueary remains that slamming the locker door was him 'doing something to stop it.'

3:44 p.m. - Rominger asks McQueary if he played in a Second Mile golf tournament. He said he did in 1998 and 1999 but not after the incident. "I made a strong attempt to not be associated with anything Jerry was involved in," he said. "I haven't played in it in several years…because of what I saw." McQueary said he did play in an Easter Seals charity football game. Sandusky was an honorary coach but McQueary said he did not know that.

3:45 p.m. - McQueary said his meeting with Paterno lasted five minutes. "Coach Paterno didn't like talking for a long time, yes sir," McQueary said. To the Grand Jury, McQueary said he did not leave out any details when he talked to Paterno. The attorneys speak to the judge at the sidebar.

3:49 p.m. - Rominger asks McQueary if he ever told someone that he saw a young boy's head look out from the shower and saw Sandusky pull him back. McQueary said "no way."

3:51 p.m. - Investigators knocked on McQueary's door and his wife was home. Investigators contacted him and they set up a time to speak. "I just want to be clear that I didn't see something…and never do anything," McQueary said.

3:52 p.m. - Rominger asks McQueary if he followed up with police. He asked him why he didn't leave. "I would never resign from Penn State University," McQueary said.

3:54 p.m. - State Prosecutor Joe McGettigan questions McQueary again. McGettigan asks McQueary if anyone told him to say what he said before. He said no. McGettigan asks, do you believe you saw the defendant sodomizing a young boy?: Yes.

3:55 p.m. - McQueary leaves the witness stand and says "I'm too big for this" (referring to his height in comparison to the size of the witness stand).

3:56 p.m. - Joseph Miller takes the stand. He was an assistant wrestling coach for elementary school. He met Victim 1 when he was in the third grade and he was a small kid. Miller said Victim 1 was a hard worker and they gained a lot of respect for him. Miller said Victim 1 was always full of energy. Wrestling practice started around 6 p.m. and went to 7:45 p.m. Miller said Victim 1 was usually one of the last ones to leave practice though is grandfather was quite punctual when he picked him up. Miller said he knew Sandusky's name from the Second Mile and even shook his hand once at a golf tournament. "I was always a big fan of what Jerry did with the Second Mile," he said.

4:00 p.m. - Miller said he would see Victim 1 and Sandusky in the middle school hallways. "I thought it was a great thing because (Victim 1) needed a father figure," he said. Miller said sometimes Victim 1 would help with the elementary wrestling practice.

One day Miller's son forgot his bag so they turned around to go back and get it. Miller got the bag and noticed a light on and the door was propped open to the weight room. He opened the door to turn the light off and figured someone just forgot to turn it off. He saw Victim 1 and Sandusky face-to-face on their side on a small practice mad. Sandusky propped him up on one arm and said "Hey Coach! We're just working on a wrestling moves." Miller said: "Ok, Jerry, no problem just make sure you turn the light off and secure the door before you leave."

4:04 p.m. - Miller said in the car later he wondered why they were practicing wrestling moves in the weight room when there was a full wrestling room. But then he thought: "He's a saint, you know, what he's doing with these kids is fantastic…So I didn't think anything of it." Sandusky and Victim 1 looked startled when Miller entered the room. Miller said it is possible in wrestling that you could wrangle yourself in to the position that Sandusky and Victim 1 were in.

4:06 p.m. - Amendola begins cross-examination. Amendola asks about the time frame of the incident. He said it was during wrestling season around 8 p.m. Miller said it was about 5 minutes from the time he left the school to the time he came back. Miller said when he walked in to the room Sandusky and Victim 1 were about 20 to 25 yards away from the door. Miller said that over by the rock wall there are small wrestling mats. Miller said he was surprised to find anyone was in that room because nobody was supposed to be in there at that time. Amendola asks if Sandusky "jumped up like a rabbit" (something Victim 1 said earlier). Miller said he did not stand up but did prop himself up "pretty quickly." Miller said he did not mention it at the time. He dismissed it from his mind because, "I had the utmost respect in the world for Jerry."
