Emotional testimony continues in murder hearing

CARLISLE, Pa. (WHTM) -

More graphic and emotional testimony was heard in a Cumberland County courtroom Thursday as a hearing to determine the degree of murder from a July 2009 shooting death continued.

Perhaps one of the most shocking elements of the crime, in which Ricky Miller admits he shot Kenneth Geiger, was the fact that Miller's three young children were sitting just inches away from Geiger in the backseat of the car when the shooting happened.

Thursday, Miller's oldest child, who was only five-years-old at the time of the shooting, was called to testify.

The now eight-year-old spoke in front of a camera in a different room, but broke down instantly as prosecutors started asking him questions.

Miller broke down in tears in the courtroom as he watched his son tell of the crime.

The prosecution rested their case Thursday, as the defense started theirs. They called Geiger's former wife, Kristen Geiger, as well as a friend and an uncle to the stand.

The defense focused on a series of text messages between Miller and Kristen Geiger in the weeks leading up to the shooting.

Kristen Geiger testified that Miller had contacted her with concerns about his children being around her estranged husband.

Miller's estranged wife, Ashley, had been dating Geiger during this time.

The hearing is expected to conclude on Friday.  If the judge determines the crime was first degree murder, Miller will likely spend life in prison.
