According to two search warrants obtained Tuesday night by abc27, two men are in custody as prime suspects in the murder that occurred on East King Street Monday night. Police still have not released the name of the victim, pending next of kin.More >>
CHAMBERSBURG, Pa. (WHTM) -
Franklin County District Attorney Matthew Fogal plans to seek the death penalty against one of two Chambersburg men charged in an October shooting death inside an East King Street home.
Fogal announced Wednesday that he has filed a Notice of Aggravating Circumstances in the case against Carl Varner. The paperwork allows prosecutors to request the death sentence as punishment for a conviction of first-degree murder.
Varner, 54, is accused of killing 29-year-old Victor Hugo Campos-Olguin during a home invasion robbery on October 22.
Police have said Varner and 38-year-old Jason C. Shauf, also of Chambersburg, went into the home at 310 East King armed with guns and demanded to see "El Gallo," then forced six people in the home to the second floor while demanding money and other property.
Shauf fired a gunshot into a bedroom ceiling during the incident and Varner shot and killed Campos-Olguin in the bathroom, according to police.
Both men were arrested October 23 following standoffs with police at their homes. Each is being held in the Franklin County Prison without bail on counts including first-degree murder, robbery, burglary and conspiracy.
Fogal cited three aggravating circumstances for seeking the death penalty against Varner. He said Varner killed while committing another felony, knowingly created a grave risk of death to another person in addition to the murder victim, and has a significant history of felony convictions involving the use or threat of violence to the victim.
