Law suit filed against bus company in Seton Hill crash

HARRISBURG, Pa. (WHTM) -

A Seton Hill University lacrosse player injured in a bus accident in Carlisle on Saturday has filed suit against the bus company saying the driver was "negligent and reckless."

Amanda Michalski, who is still hospitalized at Penn State Hershey Medical Center, filed the suit against Mlaker Transportation, Inc. in Allegheny County Thursday. She is being represented by the Philadelphia firm Kline and Specter.

The driver of the bus, Anthony Guaetta, 61, died at the scene of the accident. Seton Hill lacrosse coach Kristina Quigley, 30, of Greensburg, and her unborn child, Jackson, were pronounced dead at Penn State Hershey Medical Center shortly after.

Michalski, of Coon Rapids, Minn. is listed in good condition at Penn State Hershey. She is a first year lacrosse player at Seton Hill.

In the suit, Michalski alleges that "The bus collided with the tree because Mr. Guaetta failed to keep the vehicle under proper control and because he was otherwise negligent and reckless in the operation of the bus."

The suit is for an unspecified amount.

When abc27 News looked into Mlaker Transportation's safety profile on Sunday, their safety record is nearly perfect. According to Mlaker's website, the U.S. Department of Transportation has given them the highest rating, satisfactory.

On Saturday, they released a statement expressing their sympathy to those involved.

"Mlaker Transportation places the safe transportation of all of our passengers at the highest level. With more than 40 years in operation, we strive to make a trip on one of our coaches a great experience," it said.

State Police's investigation into the accident is ongoing and could take several week. No criminal charges have been filed in relation to the accident.
