CONESTOGA, Pa. (WHTM) -
Police in Lancaster County said they will not file charges against a Conestoga man who fatally shot his brother last month.
Manor Township police said 22-year-old James Leonards shot 27-year-old Christopher Leonards in self-defense, and the investigation has been closed.
Christopher Leonards, of Millersville Road, was shot to death in his brother's home in the 100 block of Oak Road on the night of February 1. His brother was taken into custody for the shooting, but was later released.
Authorities said their investigation determined that Christopher Leonards was intoxicated and began to physically assault and choke his younger and smaller brother, who eventually broke free and retreated to the end of a hallway.
Fearing for his life, James Leonards picked up a nearby handgun and fired as Christopher continued the assault and charged down the hallway at him, police said. Christopher was struck by the bullet and died at the scene.
Police said a witness to the assault and shooting corroborated James Leonards' account of the incident.
