LANCASTER, Pa. (WHTM) -

A Lancaster man who is serving time for shooting a Weis Market employee has lost his appeal for a lesser sentence.

Kenneth Peralta, 41, is serving 35 to 70 years in state prison after pleading guilty to the November, 2010 shooting.

Prosecutors said Peralta beat and shot a loss prevention employee who was trying to stop him from shoplifting at the Bridgeport store in East Lampeter Township.

Peralta's defense attorney says the sentence is excessive, but a Superior Court judge disagreed.
