Former Buchanan Fire Chief Pleads Guilty to Lesser Charge

Botetourt Co., VA – Billy Joe Carter, Buchanan's former fire chief will spend five and a half years in prison after pleading no contest in Botetourt County Circuit Court Thursday.

A judge then found Carter guilty of four felonies. 

As part of the plea agreement, the rape charge was amended to misdemeanor sexual battery, which means Carter will not have to register as a sex offender.

Carter was charged with rape in November of 2012 and was facing three life terms if convicted.

In a tearful address to the court Thursday, Carter maintained his innocence and said he was simply tired of fighting.

Carter stepped down from his post in 2012 after being charged in two different incidents including an assault charge at the Buchanan Fair. The charges were later dropped.
