Motion filed to revoke Birmingham business owner's passport

A motion has been filed to revoke the passport of a Birmingham business owner accused of shooting at a woman who claimed to have found a roach in her eggroll.

Court records show the motion was filed March 4 against Chun Ching, owner of the Good Friend Chinese and Seafood Restaurant. 

Birmingham Councilwoman Sheila Tyson tells ABC 33/40 she wrote a letter to Jefferson County District Attorney District Attorney Brandon Falls urging his office to file the motion to revoke Ching's passport.

ABC 33/40 has learned Ching is a U.S. Citizen and a foreign national.

Ching's attorney Carl Chambers says, since the motion was filed, he has obtained Ching's passport and will turn it over. He insists Ching would never try to flee and is looking forward to his day in court. 

Ching's preliminary hearing is set for April 22 in the Jefferson County courtroom of Judge Katrina Ross.
The Birmingham "Show Cause" hearing to consider revocation of the business license is rescheduled for March 18.
