Danville, VA - A man who killed a man in a Danville home invasion is scheduled to be sentenced Tuesday.

In February, 27-year-old Tony Ray Spivey and 44-year-old Robert Dale Warner pleaded guilty to several charges including first degree murder and burglary.

Spivey will be in court Tuesday while Warner will be in court later in the week.

The charges stem from a home invasion on Edmunds Street last October.

52 year old Charles Earles was at his home when police say he was assaulted.

He suffered a head injury and died days later.
