2 men charged with capital murder in death of Hueytown man during burglary

Two men have been arrested and charged in connection with the murder of a Hueytown man during a burglary last month, police announced today.

Romell Markee Cunningham, 28, and Kamal DeWayne Potts, 23, are charged with capital murder for the death of 66-year-old Howard Arthur McKee, who was a retired Birmingham firefighter and war veteran.

According to police, the two suspects allegedly broke into McKee's home on West Harlem Avenue on the afternoon of Apr. 23 and proceeded to steal a television and other items. Unbeknownst to the two men, McKee was at home during the burglary and was prepared to defend himself with a weapon of his own. Once the suspects realized they weren't alone at the house, the duo fled outside. During his attempt to chase down the intruders, McKee was fatally shot in his front yard.

"This was not a drug deal gone bad. This was not a gang-related shooting," Hueytown Police Chief Chuck Hagler said. "Mr. McKee was a completely innocent citizen killed at his own home by criminals for nothing more than a few household items."

Hagler said a girlfriend of one of the suspects was present at the time of the incident, though, she is only a person of interest at this time.

The Birmingham Police Department, U.S. Marshals and the FBI assisted police in the case and subsequent arrests of Cunningham and Potts, both of whom remain in the Jefferson County Jail without bond.
