Posted:

Pittsylvania Co., VA - One of the men found guilty of assaulting a man who was found dead in his car is appealing the judge's decision.

Devin Daniel appeared in Pittsylvania County General District Court Tuesday.

A judge found him along with Brandon Walker and Corey Holt guilty.

Daniel was sentenced to two months in jail, but is appealing.

Walker received a one month sentence and Holt will spend five days behind bars.

A juvenile was also charged in this case.

Last August, 19 year old Charles Michael Abbott was found dead in his car after a party on Chestnut Level Lane in Blairs.

The prosecutor wants to make it clear that there was no fight - Abbott never got a punch in, he was attacked.

The Medical Examiner later ruled his gunshot wound was self-inflicted.
