3 teens acquitted of rape outside York Fair

YORK, Pa. (WHTM) – Three teenage boys have been found not guilty of raping a 14-year-old girl near the York Fair in 2017.

Andrew R. Miller, Kelvin J. Mercedes, both 17, and Daishon M. Richardson, 18, all of York, were acquitted by a jury Friday of all charges, including rape, involuntary deviate sexual intercourse, false imprisonment, terroristic threats, and sexual assault, according to court records.

The teens were 16 years old when they were charged as adults in November 2017.

The girl told police she was at the fair with friends on Sept. 22, 2017, when the boys asked her to go with them to a nearby business parking lot. She said they put a gun to her head and forced her to perform sexual acts, then raped her at another location.

She said the boys also made a video recording or took photographs of the assault.
