DA: Fatal shooting in York justified


YORK, Pa. (WHTM) – A 23-year-old man was shot and killed in a York home after he broke into the residence and assaulted a person who lived there, police said Friday.

York County District Attorney Dave Sunday has concluded the killing of Christian Gutierrez-Rosado is a justifiable homicide.

Gutierrez-Rosado broke into 702 West Princess Street through an upstairs window early Wednesday then assaulted a resident. The resident fired one shot that struck Gutierrez-Rosado in the chest.

Gutierrez-Rosado was previously charged with felony strangulation against a resident of the home and was not allowed to be on the property, police said.
